## Notice

Warwickshire County Council ("the Council") requires a Supplier for the service of Composting separately collected Garden Waste. Procured under 3 Lots. Lot 1 - Composting of separately collected Garden Waste, mainly arising in North Warwickshire. Lot 2 - Composting of separately collected Garden Waste, mainly arising in Nuneaton and Bedworth & Lot 3 - Composting of separately collected Garden Waste, mainly arising in Rugby. Lot 1. Composting Garden Waste, mainly North Warwickshire Description Composting of separately collected Garden Waste, mainly arising in North Warwickshire: Exclusivity to compost Garden Waste collected at the kerbside in North Warwickshire Borough. The lot may also include (as an additional service) up to an anticipated 30% of the separately collected kerbside Garden Waste tonnage arising in Nuneaton and Bedworth Borough. HWRC tonnage may be included (as an additional service). Lot 2. Composting Garden Waste, mainly Nuneaton and Bedworth Description Composting of separately collected Garden Waste, mainly arising in Nuneaton and Bedworth. Exclusivity to compost at least 40% of the Garden Waste collected at the kerbside in Nuneaton and Bedworth Borough. This lot may include up to 100% of the separately collected kerbside Garden Waste tonnage arising in Nuneaton and Bedworth. HWRC tonnage may be included (as an additional service). Lot 3. Composting Garden Waste, mainly in Rugby Description Composting of separately collected Garden Waste, mainly arising in Rugby . Exclusivity to compost Garden Waste collected at the kerbside in Rugby Borough. The lot may also include (as an additional service) up to an anticipated 30% of the separately collected kerbside Garden Waste arising in Nuneaton and Bedworth Borough. HWRC tonnage may be included (as an additional service).

Composting Garden Waste, mainly North Warwickshire

Options: The satisfactory performance of the contract may be affected by external factors beyond the control of both the Council and the Supplier. In particular, changes arising from Local Government Reform (LGR), legislative developments, or other external influences may impact the delivery or scope of the contracted services. These risks, which cannot be fully mitigated within the terms of the contract at the time of award, include but are not limited to: Evolving Council needs and funding changes Changes in the Council's strategic priorities, operational requirements, or service delivery models. Variations in budget allocations as a result of the Council's internal budget setting process. The introduction or withdrawal of external funding streams which were unknown at the time of contract award, potentially affecting the volume, scope, or nature of the services to be delivered. Legislative, structural and organisational changes New legislation, statutory guidance, or national policy affecting the Council's operations or service responsibilities. Structural changes within the Council as a result of LGR, including the novation of existing contracts to a new legal entity or the onboarding of other organisational entities within Warwickshire. Variations in service demand or delivery resulting from wider reorganisation of local government services. Technological advancements The emergence of new or improved technologies that were not available or anticipated at the time of the contract award, which may present opportunities or adjustments in service delivery or system compatibility. Tenderers are expected to demonstrate flexibility and a proactive approach in managing such changes, should they arise during the life of the contract. The Council will work collaboratively with the successful Supplier to manage any requirement adjustments in a fair and transparent manner, subject to legal and procurement constraints. The Government's ongoing programme of local government reorganisation, as outlined in the English Devolution White Paper, may significantly alter the current two-tier structure in Warwickshire. Proposals under consideration include the establishment of either a single unitary authority or two separate unitary councils for North and South Warwickshire. These changes aim to streamline service delivery, improve efficiency, and enhance local accountability. While the current waste management responsibilities are shared between the County Council and the five District and Borough Councils, any future restructuring could impact governance arrangements, operational responsibilities, and contractual frameworks for waste collection and disposal.

Renewal: The service will be required for an initial contract term of 5 years however, WCC reserves the right to extend the contract by further multiple periods not exceeding 60 months, 60 months being the maximum extension period. The extension period(s) are at the Council's discretion.
