## Summary

The Ministry of Justice in the United Kingdom is conducting a procurement process for the re-procurement of HMCTS Approved Enforcement Agency Services. The aim is to develop a new generation of services to ensure fair, efficient, and resilient enforcement of court orders. This process, in the planning stage as of 31 October 2025, will feature early market engagement with an event scheduled for 18 November 2025 via MS Teams. Located in London, the Ministry is interested in understanding the market's capacity and capability to provide these services. Key industry categories include justice and police services, with the commercial strategy and operational model being shaped through supplier interactions.

This tender opens up significant opportunities for businesses specializing in enforcement services, particularly those that can support the execution of Warrants of Control and Arrests, as well as other court-directed activities. Small and medium-sized enterprises (SMEs) are welcome to express interest in this re-procurement, which promises a conducive environment for service continuity and national enforcement capability. Companies with expertise in justice services, capable of ensuring timely justice outcomes, will find this opportunity aligns with their growth objectives and potential contributions to justice delivery on a national scale.

## Notice

HMCTS currently uses private contractors, known as Approved Enforcement Agencies (AEAs), to support the criminal courts by enforcing financial penalties and other criminal court orders. AEAs provide services including the execution of Warrants of Control and Warrants of Arrest, enforcement of breach arrest warrants, direct engagement with defendants to secure compliance where appropriate, and related court-directed activities such as seizure and sale arrangements. HMCTS intends to re-procure these services to ensure continuity of enforcement capability nationally and resilience in service delivery. AEAs are permitted under statute to recover their costs through recovery fees charged directly to defaulters on Warrants of Control. We are keen to engage on this re-procurement to inform the future design and delivery of these critical services. This represents a significant opportunity for enforcement providers to contribute to the delivery of justice outcomes.

HMCTS is developing the next generation of Approved Enforcement Agency (AEA) services to deliver fair, efficient and resilient enforcement that upholds the authority of the courts and ensures timely justice outcomes.
