## Summary

The Ministry of Defence, based in Bristol, United Kingdom, has completed the procurement process for the contract titled "709986452 - The Supply of Fume Cabinet Spares and Repairs Services Contract Award Notice" under the Repair and Maintenance Services industry category. This contract involves the supply of fume cabinet spares and repairs services across various defence aircraft maintenance facilities in the UK. The procurement method used was a limited process, and due to technical reasons, it was awarded without prior publication of a call for competition. The initial contract, signed on 2nd October 2025, spans five years with an option for an additional four years and holds a contract value of £552,655. The award was made as of 6th October 2025 to Fumecare Ltd, the original equipment manufacturer, owing to their unique technical expertise in handling the specific requirements of the fume cabinets.

This tender presents significant growth opportunities for businesses, particularly those possessing specialised skills in repair and maintenance services, as well as technological expertise in handling specialised equipment. Companies like Fumecare Ltd., a small or medium enterprise based in Liverpool, exemplify the type of business suitable to compete in such tenders, especially when experience and technical knowledge specific to the equipment—like fume cabinets used in defence—is critical. This procurement process illustrates the potential for niche businesses to secure long-term, high-value contracts by leveraging their technical unique selling points and expertise in specialised services within the public procurement space.

### Procurement Information

In accordance with the provisions of The Public Procurement (Amendment etc.) (EU Exit) Regulations 2020 SI No. 2020/1319, this procurement falls to be regulated under the provisions of the Public Contracts Regulations 2015 as amended (in particular by SI 2020/1319). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with regulation 32(2)(b)(ii) of the Public Contracts Regulations 2015 because competition is absent for technical reasons. This is because Fumecare is the Original Equipment Manufacturer (OEM) of the Cabinet and has supported it since it was introduced into service in 1997. Only the OEM has the drawings, information, technical expertise, and tools necessary to support this critically important piece of safety equipment which is used to remove toxic dust, fumes and aerosol vapours when testing aircraft components for early signs of failure such as cracks and metal fatigue. In particular, due to the age of the Cabinet, certain of its key electronic components are now obsolete and only the OEM has the expertise to upgrade them to the required technical and safety standards.
