## Summary

The public procurement process initiated by Leicester City Council involves the provision of adults social care services for the Best Interests Assessors service, as a statutory requirement under the Deprivation of Liberty Safeguards. This contract was awarded directly to Action First Assessments Limited under a below threshold, without competition procurement method, adhering to the Light Touch Regime. This ongoing procurement is in the award stage, with the contract period set to start on 1st December 2025, and a maximum extension potential until 6th February 2026. Located in Leicester, UK, this procurement falls under the industry category of other community, social, and personal services. Key dates include a future contract signature due on 29th November 2025.

This tender provides excellent opportunities for growth, particularly for small and medium-sized enterprises (SMEs) like the awarded supplier, Action First Assessments Limited. Businesses with expertise in statutory social care services, particularly those with experience in the Deprivation of Liberty Safeguards, are well-suited to engage with such procurements. The direct award process simplifies the entry by negating competition, while the extension potential offers business continuity and stability. Companies looking to expand within the public sector and specifically in social care services may find significant advantages in participating in similar future opportunities.

## Notice

This is a below threshold direct award under the Light Touch Regime, on the basis of Schedule 5 (7), continuity of service whilst an existing procurement is concluding. The Best Interest Assessors (BIA) service is a required statutory function under the Deprivation of Liberty Safeguards. It is therefore unavoidable for the local authority not to provide this service. The service assists the Council to deliver their statutory responsibilities, as outlined in the Mental Capacity Act 2005 and subsequent Deprivation of Liberty Safeguards, to ensure that where a decision to deprive someone of their liberty is required it is made lawfully and based on relevant best practice, guidance and case law. This is a partly retrospective Direct Award commencing from April 2025 - November 2025 with the option to extend up to February 2026. However, as this is a statutory requirement, the Direct Award was required to ensure compliance whilst the new contract is being mobilised and due to commence.
