## Notice

The provision of Maintenance & Technical Support of Programmable Logic Controllers and Control Equipment manufactured and supported by the original equipment manufacturer (OEM) - Rockwell Automation Limited, including: On-site support, breakdown support, telephone support, servicing, maintenance and associated parts as specified in the install base inventory and targeted P1 managed between Sellafield and the OEM regarding equipment already in situ and used by Sellafield.

It has been determined that in current circumstances that competition is absent for technical reasons pursuant to Schedule 5 paragraph 5(a)(b) and 7(a)(b) of the Procurement Act 2023. Justification for the award is as follows: The Contract includes the provision of proprietary software, firmware and embedded components with intellectual property rights owned by the original equipment manufacture (OEM) - Rockwell Automation Limited. A change in supplier would result in the contract authority receiving software/goods that are different from, or incompatible with, the existing works and using alternative suppliers could invalidate warranties controlled by the OEM. Changing suppliers would require reverse engineering, revalidation, and potential compatibility issues which could impact Sellafield's ability to operate its existing control systems.
