## Notice

The contract is for services to support Adult's and Children's Social Workers to improve their understanding and approach to accessing CHC and CC funding for health needs. A new contract will support the Council and the CHC/CC Governance Board to improve strategic interface between the ICB (commissioners for CHC and CC) and the Council, with the development of enduring policies and procedures, and highly specialist support for legal challenges in relation to accessing this funding. The contract will build and embed training and knowledge to support our ability to access ICB funding post contract completion, and continue with existing and potential legal challenges. The Council is seeking assistance and advice in recovery of funding where CHC or CC eligibility has been established. Social Workers require training in this area to enable effective input to the assessments carried out by the ICB. The contract period shall be 12 months with the option to extend up to a further 12 months, in increments of 6 months (i.e. 12 months + 6 months + 6 months).

### Procurement Information

There are limited circumstances in which a contracting authority is permitted to award a public contract in accordance with the Procurement Act 2023, to a supplier without first running a competitive tendering procedure. These are provided for in section 41 of the Procurement Act 2023 and referred to as 'direct award justifications'. Schedule 5 sets out the direct award justifications. Pursuant to Schedule 5, paragraph 6 "(a) due to an absence of competition for technical reasons, only a particular supplier can supply the goods, services or works required, " The provider has the niche skills, knowledge and expertise in this area (the Council has tested the market) and we are of the view they are the particular supplier with the specific capabilities required for this Contract. There would be disruption and potential significant loss in revenue for the Council if providers were changed at this time, plus it is beneficial for continuity of existing challenges for recovery of the funding. Further, it has been established that there are no other suitable suppliers to change to at this time. and "(b)there are no reasonable alternatives to those goods, services or works. " If the Council did not proceed to award a contract, then we would have to discontinue the work and there is no reasonable alternative to achieving the opportunity to gain the benefit of recovering etc. significant external funds. Without the provider's expertise, the Council would not achieve the equivalent opportunities of gaining the CHC and CC funding. Accordingly, it is justified under S41, Schedule 5, paragraph 6 to direct award to Hindon Consultancy Ltd.
