The London Borough of Haringey (the Council) has committed to deliver 3,000 Council homes by 2031 to address the housing crisis within the borough. The Council intends to enter into a development construction agreement with Fairgate Tottenham Limited to deliver 565 homes. Fairgate Tottenham Limited own the development site and are also a developer themselves. Having been granted planning permission for the development the Council have negotiated terms for the lease of the land and the purchase of 565 homes. The value of this procurement has been set as PS260 million.

### Procurement Information

It is considered that the contract can be awarded by a way of a Direct Award to Fairgate Tottenham Limited (the Developer) in accordance with section 41(6) and Schedule 5 - Single Supplier, paragraph 5 of the PA23 due to the exclusive rights and not having reasonable alternatives sites for the works relating to this procurement. The Developer owns the land and has gained planning permission where the development will be constructed and therefore have an exclusive right to develop on that land. Additionally, there are no presently known or available development sites that benefit from an existing and implementable planning permission of comparable scale or capacity. In the absence of such consent and given the material time, cost, uncertainty, and procedural risk inherent in procuring a new planning permission for a development of this magnitude, no alternative location could reasonably be regarded as a viable or deliverable option capable of meeting the Council's strategic objectives within the required timeframe.
