In accordance with our interpretation of the Public Contracts Scotland Regulations, the National Waiting Times Centre Board (Golden Jubilee) intends to enter into a three year contract with Johnson Controls as the only supplier capable of meeting the Board's requirements The requirement is specifically for the ongoing maintenance and support of the existing Metasys Building Management Systems installed within the main hospital building and the surgical centre. Johnson Controls is the original equipment manufacturer and system proprietor of the Metasys platform and is uniquely placed to provide specialist maintenance and software support.

### Procurement Information

Under Regulation 33(b)(ii) of the Public Contracts (Scotland) Regulations 2015, competition is absent for technical reasons. The National Waiting Times Centre Board (Golden Jubilee) is satisfied that Johnson Controls is the only provider capable of meeting the Board requirements due to the Metasys Building Management System operating on a closed proprietary protocol requiring full software access to manage and amend system functions.
