## Summary

The procurement process initiated by Burnley Borough Council involves a strategic partnership with Burnley Leisure & Culture to extend the existing funding and management agreement for leisure and cultural services in Burnley. This contract falls under the "Recreational, cultural and sporting services" category, with a procurement status marked as complete. The council used a direct procurement method due to specific governance reorganisation circumstances. The award, titled "Burnley Borough Council and Burnley Leisure & Culture - Strategic Partnership, Deed of Variation," amounts to £3,739,872 and will become effective from 1st April 2029 until 31st March 2030, with a possible extension until 2032 at the council's discretion.

This procurement presents substantial opportunities for businesses involved in leisure and cultural services, particularly large enterprises and those structured as voluntary, community, and social enterprise (VCSE) organisations. The strategic partnership secures ongoing service delivery and allows the successor authority post-local government reorganisation to implement a smooth service transition, ensuring minimal disruption to Burnley residents. Thus, businesses with experience in governmental collaborations, and those that can offer continuity and scalability in service provision, are ideally positioned to benefit from participating in similar future tenders.

## Notice

The extension of the existing funding and management agreement with Burnley Leisure to provide Leisure and Cultural Services and activities to the Borough of Burnley.

### Procurement Information

Due to Local Government Reorganisation (LGR), there is insufficient manager capacity to bring the services back in house or undertake a new procurement exercise prior to LGR. Running a new procurement exercise is costly and unless the council offers a long term agreement the opportunity is highly unlikely to attract competitive bids. Any such long term agreements would bind the successor authority under LGR to a current borough level strategic partnership. While the council should not make decisions now, that could fetter the decision making of future councils, it can make decisions that are necessary to ensure a smooth transition and to secure ongoing and future best value in service delivery. A short period of continuity reduces the risk of disruption to core leisure & cultural services for Burnley Borough residents in the immediate aftermath of reorganisation. The successor authority would then be in a position to plan any transition accordingly. The extension of this agreement falls within the remit of the permitted modifications to public procurement rules within schedule 8 regulation 74 of the Procurement Act 2023. This extension, in advance of LGR in Lancashire, will allow the successor authority to plan any proposed transitions in an appropriate manner and sensible timeframe.
