Reopening of Open Framework For Workforce Technology Systems (RM6387) for locally delivered Workforce Systems which seeks to continue to support the NHS Long Term Plan and People Digital Plan by providing a route to market for all software systems and digital solutions in use, to support the management, deployment and development of jobs and staff and associated reporting and analytics.

### Planning Information

As part of the pre-market engagement notice itself, please include the following:
The Framework Terms and Conditions have been updated to reflect the requirements of the Procurement Act 2023, replacing the previous version,
As part of this update, we have adopted the NHSE Combined Supply of Goods and Provision of Services Terms and Conditions for open frameworks. These standard terms were not available when the original Workforce Technology Systems Framework procurement was undertaken in 2025.
In addition to aligning the documentation with the Procurement Act 2023, we have undertaken a comprehensive review of the Framework Agreement and Call-off Agreement to simplify the contractual requirements for both customers and suppliers, remove duplication, and strengthen a number of key provisions. This includes removing obligations relating to areas that are outside the scope of the Workforce Technology Systems Framework (for example, Life Sciences) and streamlining certain operational requirements.
For example, removal of obligations for things which aren’t even in the scope of workforce technology systems e.g. Life Sciences. Also, by example it would be no longer necessary to provide an individual Business Continuity and Disaster Recovery (BCDR) plan as contracting authorities can use the plan submitted at framework level (unless you agree otherwise with the customer and wish to use the optional schedule).
The review has also removed duplication between the Framework Agreement and the Call-off Agreement to improve clarity, eliminate the potential for conflicting provisions, and ensure that core contractual obligations are established at framework level, providing greater consistency and protection for both suppliers and customers.
This work has been undertaken in collaboration with Mills & Reeve, who developed the Government Commercial Function (GCF) framework and call-off templates for procurements conducted under the Procurement Act 2023.
Please note that, following completion of the annual framework reopening process, the updated Framework Agreement and Call-off Terms and Conditions, including the revised modern slavery provisions, will apply to both existing suppliers and newly appointed suppliers.
