## Summary

The procurement process for the provision of ophthalmology services at HMP Morton Hall has been completed under the Direct Award Process due to an urgent situation. This contract was awarded by the Northamptonshire Healthcare NHS Foundation Trust, a body governed by public law, situated in Kettering, United Kingdom. As part of the Health Care Services regulations 2023, this award was necessary to ensure continuity of care in the facility and falls outside the scope of the Public Contracts Regulations 2015. The process employed a limited procurement method without prior publication of a competition call, and the contract was signed on 18th February 2026. The contract involves health services, specifically ophthalmology, and further details indicate a focus on maintaining service continuity with existing suppliers due to the urgent nature of the situation.

This tender creates opportunities for businesses, particularly those specialising in emergency healthcare provisions, to demonstrate their capability in delivering high-quality service under extraordinary conditions. The primary target businesses are those experienced in rapid deployment and healthcare management, particularly within secure environments like HMP Morton Hall. Companies with competencies in healthcare service provision and a track record of handling urgent contractual obligations would find this opportunity beneficial to expand their portfolios. Given the project's urgency and specific requirements, this presents a valuable prospect for businesses experienced in navigating complex health service frameworks. Forensic Eyecare LTD, a large supplier based in Birmingham, has already become an active contributor to this project, highlighting the necessity for suppliers with robust infrastructures capable of supporting such urgent demands.

### Lot Information

Lot 1

The Trust considers that an award must be made urgently, the reason for the urgency was not foreseeable by and not attributable to the Trust due to the Emergency Award by NHS England of the Head Contract for Healthcare Services at HMP Morton Hall to the Trust. Delaying the award of the contract to satisfy the requirements of the PSR would likely pose a risk to patient or public safety. The award term reflects the novation of existing supplier subcontracts from the incumbent on existing terms to ensure the continuity of healthcare services during the mobilisation period of less than three-months. The period of mobilisation would not have allowed the Trust to identify alternative provision for the subcontracted service. The relevant authority has awarded this contract under the Direct Award Process A - Urgent situation (F03) under the Health Care Services (Provider Selection Regime) regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award.
