Due to the urgent and unforeseeable nature of the incident, there was an immediate requirement by EMR, RAIB, Network Rail and BTP to source suitable storage capacity in close proximity to an EMR location. Services include the provision of secure storage space, materials handling, access for recovery teams and short term logistics coordination to support ongoing railway operations and reinstatement activities. Due to the urgent timescales involved, it was not possible to carry out a competitive procurement procedure or comply with standard minimum tendering periods. Any delay in securing suitable storage facilities would have resulted in unacceptable safety risks, operational impacts and potential environmental harm. Accordingly, a direct award has been made in reliance on the ground of extreme and unavoidable urgency under Schedule 5, paragraph 13 of the Procurement Act 2023, where the need for the goods and services is so urgent that competitive procedures cannot be complied with.
