## Summary

National Highways Limited, a central government public authority, is undertaking a public procurement process titled "Incursion Alarm - Phase 5 - Delivery," which aims to enhance road safety. The procurement involves acquiring an Incursion Warning Radar System for Traffic Officers and road workers on the strategic road network to detect approaching vehicles and provide alerts via wearable devices. The contract, classified under the goods category with additional services, was awarded on 7th July 2026 to Race Technology Limited, a small to medium-sized enterprise based in Eastwood, UK, which specialises in this tech due to exclusive intellectual property rights. The procurement was executed through a direct award method under the Procurement Act 2023, with an anticipated contract period from 31st July 2026 to 30th July 2029, and options for renewal.

This tender offers substantial growth opportunities for businesses specialising in manufacturing and supplying safety equipment, alarm systems, and related technology. Companies adept in radar and detection apparatus production, with proprietary technology, are best suited due to the specific nature of the requirements and the absence of competitive alternatives. The procurement process aligns with technical needs for equipment calibration, software maintenance, and technology support, presenting an opportunity for suppliers to showcase innovative solutions. Businesses capable of offering comprehensive services, including equipment installation and training, will find this contract particularly beneficial due to the comprehensive nature of the required deliverables and support services. The procurement strengthens engagement with specialised tech providers, fostering long-term commercial partnerships.

### Procurement Information

A direct award under the Procurement Act 2023 is considered permissible under Schedule 5, on the following grounds: * Schedule 5, Paragraph 5 - Single suppliers (IPR / exclusive rights) The conditions are met where: (a) due to a particular supplier holding intellectual property rights or other exclusive rights, only that supplier can deliver the required goods, services or works; and (b) there are no reasonable alternatives available. * Schedule 5, Paragraph 6 - Single Suppliers The following conditions are met in relation to the public contract-- (a) due to an absence of competition for technical reasons, only a particular supplier can supply the goods, services or works required, and (b) there are no reasonable alternatives to those goods, services or works. In this case, Race Technology Limited retains ownership of the background IP, and the developed system is inherently dependent on their proprietary technology.
