### Procurement Information

Direct Award justification Schedule 5, Paragraph 13 (Extreme and Unavoidable Urgency) of the Procurement Act 2023. (a)the goods, services or works to be supplied under the public contract are strictly necessary for reasons of extreme and unavoidable urgency, and (b)as a result the public contract cannot be awarded on the basis of a competitive tendering procedure. The current supplier notified the Council in February 2026 that it is withdrawing from the waste plant hire market and therefore seeking to withdraw from the current contract with the Council. No alternative compliant procurement route can be implemented within the required timescales to avoid critical services disruption. The Council has engaged with waste plant hire suppliers listed on public sector frameworks and been unable to identify a suitable solution, therefore it is necessary to direct award a contract to a supplier able to immediately meet the Councils requirements centred around service back up and machine specification. Direct award of contract is critical to ensure the continued operation of the Councils HWRC site avoiding disruption to Harrow residents. It is considered that a short term contract of up to 2 years is necessary to enable the Council to comprehensively develop it's tender process and associated tender documentation for a full compliant re-procurement exercise which will drive best value outcomes to the Council and its Residents.
