## Summary

Bath & North East Somerset Council procured planning services for Bath Western Riverside Phase 2, the former Bath gasworks site. The requirement supports regeneration and affordable housing objectives across land partly owned by the Council and partly by St William Homes LLP. The appointed provider is to act on behalf of the Council to secure satisfactory planning permission for residential blocks and associated infrastructure on the Council’s land, which did not yet have permission. St William Homes had already secured planning permission for its own part of the wider site. The work is delivered in Bath and falls within architectural, engineering and planning services (CPV 71240000). The wider development is intended to increase affordable housing provision while addressing the planning and strategic housing requirements for the site.

This procurement is complete and was awarded through a direct, below-threshold procedure without competition. One lot was awarded to St William Homes LLP. The contract was signed on 3 August 2026 and runs from 3 August 2026 to 31 July 2029. Its value is £173,099 excluding VAT, or £207,713 including VAT. The award covers planning services for the Bath Western Riverside Phase 2 requirement. The selected supplier is St William Homes LLP, part of the Berkeley Group. The arrangement is below the relevant threshold for these services. The procurement therefore records a completed direct appointment rather than a competitive tender, with the contract now active and the planning-permission work forming the central contracted outcome.

This requirement indicates demand for planning and development expertise connected with large, complex housing regeneration schemes, particularly where land ownership, affordable housing obligations and difficult former industrial site conditions must be managed together. A credible future competitor would need demonstrable capability in securing planning permission for residential blocks and ancillary infrastructure, coordinating proposals across adjoining land interests, and translating strategic housing objectives into deliverable schemes. Experience with affordable housing provision, viability challenges, contaminated or formerly industrial sites, and public-sector regeneration priorities would be relevant. The incumbent’s established planning permission for its adjoining land also shows the value of detailed site knowledge and the ability to work across a wider development held by both a council and a private developer.

## Notice

Bath Western Riverside is a major component of the Council's SHLAA and housing delivery trajectory. The project was committed in 2010 and has successfully delivered 854 new homes with 25% affordable housing within phase 1. Bath Western Riverside Phase 2 (the Site) is the former Bath gas works site. The Site is part owned by the Council (which owns 31.5%), and part owned by St William Homes LLP (part of the Berkeley Group) (Berkeley) (which owns 68.5%). The Council intervened to acquire its part of the Site in 2019 for regeneration purposes with the objective to maximise the provision of affordable housing delivered given the viability challenges faced from the former land uses and site conditions. In order to comply with both planning and strategic housing aims, the Council must obtain a minimum number of affordable housing units across the Site as a whole and therefore has the option to either: procure the construction of such units itself, being restricted to its own part of the Site; or to increase provision by acquiring units from Berkeley (additionality) which will be constructed on Berkeley's land. Full details of the Council's intentions for the delivery of the housing scheme are set out in the Transparency Notice, notice identifier: 2026/s 000-043335 published 12 May 2026. To achieve the intended outputs for the new affordable housing scheme, Berkeley will undertake planning services on behalf of the Council to secure satisfactory planning permission (residential blocks with ancillary infrastructure) over the current Council land which does not yet have planning permission. Berkeley has already secured planning permission over its part of the Site. To the extent Berkeley receives consideration for these services from the Council, such sums will be below the threshold for the services under the Procurement Act 2023, as further set out below.
