The modification adds construction works with a maximum value of PS3,665,212", "rationale": "Need for additional works, services or supplies by the original contractor/concessionaire: The Council is modifying its existing Operating Agreement with Sports and Leisure Management Limited (SLM) to enable the Indoor Aquatic Adventure Zone (IAAZ) to be constructed and then operated as part of the existing Leisure Centre. The Council has considered whether the IAAZ could instead be constructed through a separate contractor. This was not considered appropriate because the IAAZ is a physical extension to an existing operational leisure centre building and needs to be fully integrated with the Centre's existing buildings, systems, staff, management and customer services. SLM already operates the Leisure Centre and has the operational arrangements, staff, systems and infrastructure needed to integrate the IAAZ into the existing leisure service. Using the existing arrangement will avoid the additional contractual interfaces, mobilisation costs and operational disruption that would arise from appointing a separate contractor or operator. The Council is therefore planning to modify the existing Operating Agreement under Regulation 72(1)(b) of the Public Contracts Regulations 2015 to enable the construction of the Leisure Centre IAAZ by SLM. Officers have considered the requirements of this provision and are satisfied that they are met, including that appointing a different contractor would not be appropriate for technical and economic reasons and would cause significant inconvenience and additional costs to the Council.
