The proposed award is based upon the Council's assessment that EndoTherm is a proprietary product manufactured exclusively by Endo Enterprises (UK) Ltd. Evidence supplied by the manufacturer confirms ownership of the relevant intellectual property rights, proprietary formulation, confidential manufacturing processes and technical know-how associated with the product. The manufacturer has confirmed that no third party is authorised to manufacture the product independently. The Council has reviewed alternative procurement routes, framework agreements and potential alternative solutions and has not identified an alternative supplier capable of providing the specified product or an equivalent solution capable of meeting the Council's technical and operational requirements. The Council has undertaken operational trials within its estate which demonstrated reductions in energy consumption and support the Council's objectives of improving heating system efficiency, reducing operational energy costs and reducing carbon emissions. On the basis of the available evidence, the Council considers that competition is absent for technical reasons and because of the protection of exclusive rights associated with the EndoTherm product. The Council therefore proposes to award the contract directly to Endo Enterprises (UK) Ltd."
