## Summary

The NHS Wales Shared Services Partnership (NWSSP) - Procurement Services has awarded a support contract for the deployment and ongoing maintenance of SPC Charts and Microsoft Application. The contracting process, led by NWSSP and hosted by Velindre NHS Trust on behalf of NHS Executive's Improvement Cymru team, was conducted under a limited procurement method without prior publication of a call for competition. The contract was awarded on 6th August 2024 to the BCN Group, based in Manchester, and will be in effect until 31st March 2025, with an option for a one-year extension. This falls under the health industry category, specifically providing services within the region of UKL.

This tender offers significant business growth opportunities, particularly for entities specialising in software development, data visualisation, and healthcare improvement projects. Businesses that have prior experience in developing bespoke applications and those familiar with SPC Charts will find this contract particularly advantageous, given the scope for providing training and upskilling NHS staff, thereby ensuring sustained product development and maintenance. The exclusive technical expertise and intellectual property held by the BCN Group suggest that similar businesses with specialised skills could likewise be well-positioned for such targeted support contracts in the future.

### Lot Information

Lot 1

The support contract allows for a customized Improvement Application, known as QSI Hive which was developed for NHS Executive's Improvement Cymru team in 2023 by the BCN Group. The support contract will cover a portion of development time and provide training for the Improvemnent Cymru team and will enable NHS Executive to deploy the application with robust support, instilling confidence in our users regarding the product. Additionally, there is allocated time for upskilling of staff in the contract ensuring the team gain the necessary experience and knowledge to manage and further develop the product internally beyond the contract period. The contract will run until the 31st March 2025 with up to a one year extension option if required by the Organisation.

### Procurement Information

The BCN Group was commissioned by Improvement Cymru in early 2023 to develop an application for the Organisation which will be made available to NHS Wales Staff. This application will allow Improvement Projects to be entered and maintained, and to aid in the production of improvement charts and documentation of the improvement process. BCN worked with Improvement Cymru over an 6-8 Month period to develop a bespoke system by working with Improvement Cymru and NHS Wales staff to co-design the application. BCN's significant experience in SPC Charts and therefore, the understanding of how data needs to be collected to ensure data visualisation within the platform has made this process significantly easier. As BCN are the original developer of the product, they possess advanced knowledge, IP and extensive experience regarding its functionality. In contrast, any other company would need to allocate a significant amount of time to thoroughly understand and investigate the existing work to effectively prepare for providing support as well as enter into discussions and agreements with BCN Based on the above, the Authority intends to use the negotiated procedure without prior publication in accordance with the use of Public Contract Regulations 2015 32 (2)(b)(ii) and (iii), competition is absent for technical reasons and (2) (b)(iii) - the protection of exclusive rights, including intellectual property rights and is therefore, issuing this notice and applying a 10 day standstill period.
