Justification for selected award procedure: The procurement falls outside the scope of application of the Directive Explanation: For the purposes of this contract the Council is regulated as a Utility, as it is a contracting authority engaged in the activity of the provision and operation of a heat network. See Article 8(1) of Directive 2014/25/EU and the corresponding implementing provision of regulation 8 of the Utilities Contracts (Scotland) Regulations 2016. Article 23(1) of Directive 2014/25/EU (and regulation 22 of the implementing regulations referred to above) provides that the Directive/regulations do not apply to procurement for the award of a contract by a utility active in the energy sector (by reference to Article (1)) for the supply of energy.
