The Scottish Ministers wishes to seek a bid for the recovery, search for human casualties and removal to land of the Fishing Vessel Nancy Glen.

### Procurement Information

On 18th January 2018, the Fishing Vessel Nancy Glen capsized and sank in Loch Fyne, Tarbert just outside its home port with the loss of two crew members. The vessel sank to a depth of 140m. Following the investigation of the accident by the authorities, the families of the bereaved crew approached the Scottish Ministers to recover the casualties. Due to the exceptional circumstances of the vessel having capsized within physical view of its home port, the Scottish Ministers agreed to assist in this matter. Due to the concerns of the casualties being washed away by the tidal movement or being eroded by the water and marine life, there was an extreme urgency to act quickly to ensure the recovery was done successfully. In accordance with the Public Contracts (Scotland) Regulations 2015, Reg 33(1)(C) which allows for contracts to be awarded without a call for competition in circumstances where there are reasons of extreme urgency brought about by events unforseeable by the Contracting Authority with the consequence that normal timelimits for competitive tendering cannot be complied with, the Scottish Ministers undertook a negotiated procedure without prior publication. A contract was awarded to Keynvor Morlift Limited who were on site with equipment to assist with the accident investigations. They were best placed to recover the vessel and casualties within the quickest period.
