Options: Reactive repairs as and when required. Other services as and when required, including winter gritting.

### Procurement Information

Award using negotiated procedure without a call for competition under Article 32(2)(c) of Directive 2014/24. SCRA's existing provider of FM services has now gone into liquidation. The services are essential to the safe operation of SCRA's estate and discharge of statutory duties. SCRA have urgently appointed FES FM Ltd, a sub-contractor to the previous provider, to enable continuation of provision of services. This is an exceptional situation where extreme urgency has been brought about by events unforeseeable and not attributable to SCRA, making it impossible for SCRA to conduct a regular procedure even within shortened time limits. SCRA intends to tender for the provision of these services in 2019. Award further justified by Article 32(2)(b)(ii) as a near technical impossibility for an economic operator other than this existing sub-contractor to achieve the required performance and ensure the continued functioning of the service in the circumstances (See previous VEAT Notice ID APR316164.
