Under Regulation Reg 33(1)(b)(ii) of the Public Contracts (Scotland) Regulations 2015, a contracting authority may use the negotiated procedure without the prior publication in the case of a public contract, based on the following justification: 2. Competition is absent for technical reasons (only if it is not caused by artificial narrowing down of the parameters of the procurement and no reasonable alternative or substitute exists);

Options: If budget allows, we may order an extension to the service contract. This is only limited to 12 months after the initial 2 years cover.

### Procurement Information

We wish to purchase a high resolution preclinical ultrasound scanner to replace our current model which we purchased 10 years ago and which is no longer supported by the company. Additionally since our last purchase, there has been a step-change in hardware technology which now limit the utility of the scanner in providing data necessary for high quality/impact research.
