It is considered that the award of a new contract in the circumstances detailed in this Paper is consistent with Regulation 32 (1) and (2) (b) (ii) and (iii) of the Public Contracts (Scotland) Regulations 2015, which allows the contracting authority to award a contract without a competitive process when for technical reasons or for reasons connected with the protection of exclusive rights, including intellectual property rights, a public contract may be awarded only to a particular economic operator. Micro Systemation Ltd is the owner of the software system and associated hardware and is therefore the only supplier capable of providing the solution and associated support.
