## Summary

The public procurement process involves Disclosure Scotland seeking a Delivery Partner for Digital Services and the replacement of Legacy Mission IT, valued at £7,000,000. This tender is documented under the limited procurement method, with an award completed on 1 May 2019. The buying organisation, Disclosure Scotland, is based in Glasgow (1 Pacific Quay, G51 1DZ, UK) and is responsible for important public safety operations. The procurement process is currently in the Award stage and is critical for maintaining service functionality before the current IT system is decommissioned in September 2019.

This tender presents significant opportunities for SMEs, particularly those with expertise in digital services and IT system transitions. Companies familiar with innovative digital solutions and capable of delivering complex IT projects would be well-suited to compete in future tenders of a similar nature. The ongoing development and technical support needed by Disclosure Scotland suggest that suppliers offering specialised knowledge and experience in this field have a competitive advantage in securing contracts that contribute to the safeguarding of public services.

### Lot Information

Lot 1

Disclosure Scotland consider that regulation 33(1)(b)(ii) of the Public Contracts (Scotland) Regulations 2015 allows for the negotiated procedure without prior publication of a contract notice or prior information notice in this case. The incumbent service provider is the only economic operator who has the technical ability to deliver the functionality needed for the replacement IT system before the current platform is decommissioned in September 2019. The incumbent supplier has been working with Disclosure Scotland for more than two years in developing the new system but due to the complexity of the programme this will take slightly longer than originally envisaged to enable successful completion and operation. The incumbent supplier has gained an in-depth knowledge and understanding of the requirements and functionality over more than two years working with Disclosure Scotland. This work needs to continue for a further short period of time to allow successful completion of the system to allow full operation by September 2019 for a critical public service for safeguarding. Competition is therefore absent for technical reasons as the Authority requires on-going technical development and design of this business critical service. This contract awarded is appropriately limited in duration having regard for the urgency and critical nature of the service to allow for a safe and successful transition and mobilisation of the new IT system.
