Lot 1

The Scottish Government has a requirement to place a contract with an external service provider for the provision of Decision Making about Remand & Alternatives to Remand in Scotland's Criminal Justice System. Justice Analytical Services conducted in-house analysis on the use of remand in each court in Scotland, as well as on the selection of reasons for remand within the legal framework. This research found that multiple legal reasons often influence the decision to place an individual on remand but that decisions are being made consistently across courts, in line with the provisions in existing legislation. However, it is difficult to tease out the weight being given to each of these reasons in individual remand rulings and if other factors also play a part in making that decision. There are certain courts that appear to be 'outliers' in terms of using remand, which may suggest some local, specific concerns that lead to greater use of remand. This previous research suggests that, though we have some knowledge of remand, more detailed understanding is needed of the progress of remand cases through the criminal justice system, decision-making about remand, and whether key stakeholders in justice could make greater use of alternatives. Therefore, Justice Analytical Services are commissioning mixed methods research to explore the formal and informal reasons for remand decisions and what, if any, alternatives to remand might be useful and workable. This will allow the SG to access greater levels of detail about remand, to understand everyday decision-making and why the use of alternatives to remand may vary in different courts in the context of different cases.
