## Summary

The Crown Office and Procurator Fiscal Service has completed a procurement process for "Oracle Business Intelligence (BI) Software Licencing & Support," a contract awarded to Oracle Corporation UK Ltd. This procurement falls under the services category and was conducted through a limited method without prior publication of a call for competition. The contract, valued at £178,141.03, was signed on 11th December 2019, and involves supplying software support to ensure uninterrupted operation of COPFS's case management systems in Edinburgh, UK.

This procurement presents a unique opportunity for businesses specialised in software solutions and licensing, especially those with expertise in Oracle products, to understand the competitive landscape. While competition was absent in this specific case due to Oracle owning the intellectual property rights, future opportunities may arise as COPFS explores alternative software solutions in their digital transformation strategy. Businesses capable of providing innovative case management systems or software integration services may find potential avenues for growth in collaboration with or competition against established suppliers in the public sector.

## Notice

This is a voluntary ex ante transparency (VEAT) notice. Crown Office and Procurator Fiscal Service (COPFS) has awarded a contract to Oracle Corporation UK Limited to supply Oracle Business Intelligence software support. This is to ensure continuous operation of the COPFS case management systems. Oracle is used to run the National Database which supports the PROMIS application that enables COPFS to manage and progress cases through the judicial system. It is a business critical software component available only from the stated supplier.

### Lot Information

Lot 1

Competition is absent as this software can only be procured from Oracle. As part of our Digital Transformation Strategy, COPFS is considering plans to strategically move to other solutions, however, this involves significant work and requires alignment with longer-term case management development planning and funding.

Options: The contract will be awarded for 1 year with the option to extend annually for a further 1 year. The requirement will be reviewed each year to ensure this is still the most appropriate route to market and in line with strategic digital plans.

### Procurement Information

Oracle own the IPR and licensing rights in the software. The required licenses and support to run the software package can only be provided by Oracle for technical reasons. COPFS will during the term of the contract investigate alternative solutions to support the PROMIS case management application.
