The Scottish Police Authority's ("the Authority") Forensic Services currently have purchased the necessary software and hardware upgrade to run DNA Quantifiler software on the Hamilton DNA Instrumentation. The patented product cannot be purchased from any supplier other than Life Technologies Limited due to product patent. There are no other equivalent products which may be used under the current maintenance agreement between the Authority and Life Technologies Limited. The award of this contract in the circumstances detailed in this Paper is consistent with Regulation 6 (4) (b) of The Procurement (Scotland) Regulations 2016, which allows the contracting authority to award a contract without a competitive process for additional deliveries by the original supplier which are intended either as a partial replacement of supplies or installations or as the extension of existing supplies or installations where a change of supplier would oblige the Authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance.
