## Summary

The procurement process involves West Lothian Council, which is situated at the West Lothian Civic Centre in Livingston, UK. The contract, titled "Specialist Care and Support Services for Adults," falls under the General Public Services category and is currently in the Award stage. The tender initiated on 28 April 2020, applies to three lots focusing on community support and care services for adults, including those with autism spectrum disorder, and has a total estimated value of £27,405,000 for the six-month extension. The procurement was conducted using a limited method due to the urgent need arising from the Covid-19 pandemic, which necessitated immediate action without prior publication of a call for competition.

This tender creates significant opportunities for businesses involved in social care and support services, particularly those that can cater to vulnerable adults with varying needs, including autism and learning disabilities. Companies with expertise in personal care, community support, and specialised services would find this an ideal opportunity to expand their operations. The contract allows existing framework providers a chance to continue their services, while also opening the door for new entrants in the sector, particularly those who are large-scale or small and medium enterprises (SMEs) capable of delivering quality care solutions.

## Notice

A direct award for Specialist Care and Support Services for Adults to continue with existing service provision with present framework service providers for the three Lots within the original framework. This is due to the ongoing Covid 19 situation and the unavailability of key staff for both the Council and service providers who would otherwise be available to assist with the tendering process.

### Procurement Information

The Council needs to respond immediately to the ongoing COVID-19 consequences with staff for example being diverted from their normal duties. The events that have led to the need for extreme urgency were unforeseeable and could not have been predicted by a reasonable diligent Authority. The present situation is not attributable to the contracting authority in any way and with council staff employed in other capacities it is not possible to comply with the usual timescales in the 2015 Regulations. There is also no known available framework whereby a call off contract under an existing commercial agreement such as a framework or dynamic purchasing system could be undertaken. The Council therefore perceive that the extreme urgency factors within Section 33 of the Public Contracts (Scotland) Regulations 2015 have been met and with a duty to ensure that there is service provision for vulnerable persons, it is proposed that a direct award is made for a period of six months as the full impact of COVID 19 is unknown in terms of both our own workforce and that of service providers. This will allow time for tendering activity to re-commence.
