Lot 1

The incumbent provider provides short breaks (respite) at Letham Court Residential Care Home, 2 Letham Court, Craigshill, Livingston EH54 5AY for those with medium to significant learning disabilities as well as complex physical / health care needs. The contract in place is on a block basis for six placements in total; five being on a planned basis with the remaining one being used for emergencies or unplanned situations which may arise. With a need for short break provision to be available within West Lothian for those with a medium to significant learning disability and complex physical / health care needs, the present Covid 19 situation is affecting lease finalisation and purchase arrangements. As additional time is required to finalise these matters, it is proposed that a direct award of 12 months is made to the incumbent provider.. Whilst the estimated contract value from commencement date and including proposed contract extension is GBP 2,379,168 the estimated contract extension is GBP 396,528

### Procurement Information

The Council needs to respond immediately to the ongoing COVID-19 consequences with staff for example being diverted from their normal duties. The events that have led to the need for extreme urgency were unforeseeable and could not have been predicted by a reasonably diligent and informed Contracting Authority. The present situation is not attributable to the Contracting Authority in any way and with council staff employed in other capacities it is not possible to comply with the usual timescales in the 2015 Regulations. There is also no known available framework whereby a call off contract under an existing commercial agreement such as a framework or dynamic purchasing system could be undertaken. The Council therefore perceive that the extreme urgency factors within Section 33 of the Public Contracts (Scotland) Regulations 2015 have been met and with a duty to ensure that there is service provision for vulnerable persons, it is proposed that a direct award is made for a period of 12 months as the full impact of COVID 19 is unknown in terms of both our own workforce and that of the service provider. This will allow for short break provision to be available within West Lothian for those with a medium to significant learning disability and complex physical / health care needs and allow time for finalisation of the lease and a decision around the purchase of the property prior to undertaking tendering activity.
