### Procurement Information

The Contracting Entity, Shetland Islands Council, conducted a procurement exercise in line with EU Directive 2014/24/EU for Grounds Maintenance. On conclusion of the tendering exercise, only one tender had been submitted, by a local supplier, which on review was unsuitable. This was predominantly due to the price of the tender significantly exceeding anticipated costs and authorised budget. The Contracting Entity being located in a remote location means there is a limited number of suitable options and businesses that can reasonably tender for this specific Grounds Maintenance Contract. Accordingly, the Tender could not be accepted and the procurement exercise was abandoned for the reason of the excessive price submitted. Further to abandonment of that procurement it was considered that the only reasonable option open to the Council was to negotiate the requirements. A negotiation was therefore entered into in accordance with regulation 33 of the Public Contracts (Scotland) Regulations 2015.
