Under Regulation Reg 6(1)(b)(ii) of the Procurement (Scotland) Regulations 2016, a contracting authority may award a contract without competition based on the following justification: Competition is absent for technical reasons (only if it is not caused by artificial narrowing down of the parameters of the procurement and no reasonable alternative or substitute exists);. Our Imaging facility already has a Siemens Healthineers mMR (PETMRI) scanner installed. We wish to upgrade the head coil to facilitate combined PET/MRI imaging using this scanner. The only compatible 32-channel head coil is manufactured by Siemens for their own scanner. We therefore wish to purchase this exclusive head coil without the requirement to go out to competition.
