Under Regulation Reg 6(1)(b)(ii) of the Procurement (Scotland) Regulations 2016, a contracting authority may award a contract without competition based on the following justification: Competition is absent for technical reasons (only if it is not caused by artificial narrowing down of the parameters of the procurement and no reasonable alternative or substitute exists). The equipment is required for a follow on study on asthma attacks over 12 months. The results of this study must be comparable with the original study which used the same equipment. The equipment is compatible with different types of asthma inhalers The Adherium products retain adherence data for at least 3 months which is essential for the study. Adherium products are covered by a number of patents.
