Under Regulation 33 (1) (b) (ii) of the Public Contracts (Scotland) Regulations 2015, a contracting authority may use the negotiated procedure without the prior publication in the case of a public contract, based on the following justification: A contracting authority may award a public contract following negotiated procedure without prior publication of a contract notice or prior information notice in any of the following cases-- (b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons-- (ii) competition is absent for technical reasons; Competition is absent for technical reasons (only if it is not caused by artificial narrowing down of the parameters of the procurement and no reasonable alternative or substitute exists). In this instance, compatibility with existing software and equipment is essential. If the University were to purchase alternative lab data capture systems and equipment then alternative software would also be required Academic and technical staff are already full trained on how to use the AD Instruments lab systems. Familiarity in teaching practice is also a consideration.
