After seeking feedback from the suppliers invited to the e-auction, the Council carried out a negotiated procedure in accordance with Regulation 6 of The Procurement (Scotland) Regulations 2016: Circumstances in which a contract can be awarded without competition 6.--(1) A contracting authority may award a public contract without seeking offers in relation to the proposed contract-- (a) where no tenders, no suitable tenders, no requests to participate or no suitable requests to participate have been submitted in response to the publication of a contract notice, provided that the initial conditions of the contract are not substantially altered

### Procurement Information

The Council conducted an e-auction via Lot 3: Software and Associated Services of the Crown Commercial Services Technology Products and Associated Services Framework ref no RM6068 for this requirement on 23 August 2022. Four of the 28 suppliers invited accessed PCS-T to view the e-auction but no suppliers joined the e-auction when it was live. The Council contacted all suppliers invited to ask for feedback regarding they chose not to participate. Out of 6 responses received, 1 supplier advised they were focussing on 'other business priorities, 3 advised that Oracle Support was not part of their product range, and 2 advised that their relationship with Oracle was purely transactional and not of the standard they believed could achieve a competitive quote.
