Regulation 6(1)(b)(ii) of the Procurement Scotland Regulations states "A contracting authority may award a public contract without seeking offers in relation to the proposed contract where the works, supplies or services can be supplied only by a particular economic operator as competition is absent for technical reasons, and no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement". The requirement within this NTP is being progressed in accordance with above as it is believed competition is absent for technical reasons due to KSB being the body that monitors street cleanliness which is a statutory indicator for the council and they are the main provider of national advice to local authorities and the government around litter and waste, they also run annual national campaigns and have significant experience in engaging with communities through this process.
