This is a procurement for the provision of an additional Drug Extraction system with warranty, support and maintenance package to support the preparation of samples for analysis by the toxicology team. A Non-Competitive Action has been carried out to procure a further Extrahera system which is a trademarked technology, available from a single supplier, and is the only instrument compatible with the Authority's accredited process (Regulation 6 (4)(b) of The Procurement (Scotland) Regulations 2016)

### Procurement Information

The Biotage Extrahera(tm) Extraction System is an automated or robotic machine which prepares samples prior to examination. Its copyrighted technology uses positive pressure, rather than vacuum, to control flow rate and this makes it unique in the market. This technology almost eliminates the risk of cross contamination of samples. The system is already in use by Forensic Services and has been incorporated into its analytical process. The Authority has carried out extensive work creating the working process and applying for accreditation to an International Organisation for Standardisation ("ISO") standard. The same accredited process could not be used with any other item of equipment. Use of an alternative manual method would be inefficient and carry a greater risk of error. The purpose of this purchase is to safeguard this business critical process during periods of existing instrument downtime. The introduction of a different instrument and method would not achieve this purpose and this instrument is trademarked technology available only from a single supplier. In the circumstances, it was proposed that it would be appropriate to pursue the following procurement as a Non-Competitive Action. A Non-Competitive Action can be justified under the Procurement (Scotland) Regulations 2016: 6.--(1) A contracting authority may award a public contract without seeking offers in relation to the proposed contract-- ....... (4) A contracting authority may award a public supply contract without seeking offers in relation to the proposed contract-- .................. (b) for additional deliveries by the original supplier which are intended either as a partial replacement of supplies or installations or as the extension of existing supplies or installations where a change of supplier would oblige the contracting authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance;
