Children's Hearings Scotland (CHS) intends to award this contract to West Lothian College under the conditions of regulation 32(2)(b) of the Public Contracts (Scotland) regulations.

Options: An option to extend the contract by a further 12 months to 30 September 2025 is to be included.

### Procurement Information

32(2)(b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons: (i) the aim of the procurement is the creation or acquisition of a unique work of art or artistic performance, (ii) competition is absent for technical reasons, (iii) the protection of exclusive rights, including intellectual property rights. Due to the proposed changes to the Children's Hearing System, West Lothian College are the only supplier with the expertise, methodology and resources that would be able to complete this work in the timescale required. To ensure the continuity of essential learning for the CHS community to enable the National Convener to continue to fulfil their obligation to provide trained Panel Member to make decisions and give reasons within hearings.
