Cumbernauld is North Lanarkshire's largest town. It now has an opportunity to redefine itself as a '21st Century new town' and further develop its commercial, industrial and retail role as a sustainable, green and low-carbon regional hub. The Vision for Cumbernauld will be built around a transformed low-carbon town centre defining Cumbernauld as a hub for services, education, shopping and leisure, expressed by a new restructured mixed-use centre situated within a greenspace and parkland setting that supports active travel and leisure. The town centre will become a vibrant, mixed-use, welcoming, safe and resilient place where people are supported at all stages of their lives, where they can live and socialise and where businesses can thrive.

### Lot Information

Lot 1

To achieve the vision for Cumbernauld, the council completed the property acquisition of The Centre Cumbernauld (TCC) on 30 June 2023 from its previous owners. To enable TCC to continue operating as a viable shopping destination in the short term, the council was required to ensure that appropriate management arrangements were in situ prior to the purchase of TCC. The Asset Manager's role is to optimise the commercial viability of TCC by actively managing the leases on behalf of the council.

### Procurement Information

Justification for use of the negotiated procedure was made under Regulation 6(1)(b) of the Procurement (Scotland) Regulations 2016 - "A contracting authority may award a public contract without seeking offers in relation to the proposed contract where the works, supplies or services can be supplied only by a particular economic operator where competition is absent for technical reasons but only, in the case where no reasonable alternative or substitute exists, and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement". The use of the negotiated procedure was applied in order to minimise disruption and enable a degree of continuity for the leaseholders and customers of TCC in regard to communication, operations, processes etc. The contract has been implemented as a novation from HAMCAP (Cumbernauld) LLP (previous owners of TCC) to the Council with minor amendments made to the terms and conditions to ensure compliance with the Councils public sector duties. The contract within this award notice is for a maximum duration of 12 months (9 month plus 3 month optional extension). Work has already started to develop, procure and implement longer term management arrangements for TCC following the expiry of the contract within this award notice. The new / future management arrangements for TCC will be subject to competition and shall be procured in accordance with applicable procurement legislation and the council's General Contract Standing Orders. The procurement competition for the longer term management arrangement is currently estimated to commence in Autumn 2023.
