The existing contract is being modified on the grounds of Reg 72(1) (b) to provide for additional works, supplies or services by the original contractor that have become necessary and were not included in the initial procurement, where a change of contractor-- Reg 72(1) (b) (i) cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, services or installations procured under the initial procurement; and Reg 72(1) (b) (ii) would cause significant inconvenience or substantial duplication of costs for the contracting authority, The development of Phase 2 of the Teandallon site by the Phase 1 contractor would allow for the sharing of site services and prevent duplication of cost associated with site site up, security and associated preliminaries.
