A negotiated procedure was conducted in accordance with Regulation 6 (1)(b)(ii) The Procurement (Scotland) Regulations 2016 which states "Circumstances in which a contract can be awarded without competition6.(1)A contracting authority may award a public contract without seeking offers in relation to the proposed contract-- (b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons-- (i) competition is absent for technical reasons; but only, in the case of paragraphs (ii) and (iii), where no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement.

### Procurement Information

The Council requires the continuation of the current contract for a period of 12 months while it goes out to tender for a long term arrangement. The existing supplier is also currently working on the Windows 10 to 11 upgrade and school refresh programme within education. Their role is ensuring that non compliance risks do not manifest as a result of this ongoing migration work. Their intimate knowledge of the environment is supporting the detailed reconciliation of devices against software licenses ensuring that no double counting of non deployed devices / software occur therefore preventing unbudgeted costs.
