Lot 1

The Authority requires a short-term emergency contract for the operation and maintenance of the Energy from Waste Facility in Aberdeen. The Contractor will be responsible for providing the day-to-day operation of the facility, handling and processing of waste and providing maintenance of the plant and equipment. This contract is being put in place to ensure continuity of service following the termination of the previous contractor and will remain in effect only until a longer-term operational Contractor is procured by the Authority.

Options: Yes, optional extension of up to 6 months.

### Procurement Information

The Emergency Operation and maintenance contract is strictly necessary due to the extreme urgency brought about by the termination of the previous contract for the operation and maintenance of the Energy from Waste Facility in December 2025. The Council was not responsible for the events that led to that termination, nor was the termination foreseeable. That contract provided for a termination notice period of 20 Business Days. That was insufficient to comply with any of the time limits for open procedure, restricted procedure, or competitive procedure with negotiation, particularly for something as complex and onerous as operation of an Energy from waste facility. The shut-down of the Facility and absence of any agreement to resume operation represented serious health and safety, environmental, and commercial risks to Aberdeen City Council, Aberdeenshire Council and the Moray Council. The Facility provides a critical waste disposal function for all of these council areas. It serves around 227,000 homes and approximately 6,500 businesses. It enables the Councils to discharge their statutory duties under the Environmental Protection Act 1990. The defenders have also expended very substantial sums in constructing the Facility. They have a clear and obvious interest in ensuring that it is properly preserved and maintained. There is otherwise a very real risk that public funds will be wasted. The duration of the emergency operation and maintenance contract is only for the period that is strictly necessary to allow for a procurement of a replacement operator for the Facility, on a longer term basis, using the appropriate procedures under the 2015 Regulations.
