### Procurement Information

The Contracting Authority previously conducted a compliant competitive tender exercise (Invitation to Tender published November 2025 / NOV544517 / OCDS-r6ebe6-0000817 080) for the provision of hawking pest control services at its waste transfer stations. Following evaluation, a contract was awarded and the successful supplier commenced delivery of the services. Subsequently, the contractor entered administration and is no longer able to perform the contract. This occurred shortly after mobilisation and constitutes an event unforeseeable by, and not attributable to, the Contracting Authority. The services are required on a continuous basis during the peak seabird nesting season (March to October) to control nuisance bird populations at licensed waste sites. Failure to maintain service provision would give rise to significant environmental and public health risks, increased complaints from neighbouring communities, and the potential for regulatory non-compliance with site licence conditions imposed by SEPA. Given the immediate operational need and the timescales required to complete a new procurement procedure, it is not possible to comply with the time limits for open, restricted or competitive procedures. The absence of service provision during this period would have a materially adverse impact on service delivery and regulatory compliance. Accordingly, the Contracting Authority has relied on Regulation 33(1)(c) of the Public Contracts (Scotland) Regulations 2015 to award the contract using the negotiated procedure without prior publication. The contract has been awarded to the next ranked compliant bidder from the original tender process, who has confirmed their ability to deliver the services in accordance with their original tender submission, including pricing and terms. The use of this procedure is strictly limited to what is necessary to address the urgent requirement to ensure continuity of service.
