Scottish Futures Trust is leading the CCWP legal and commercial workstream on behalf of the Scottish Government, and this procurement is for legal advisory services to support that workstream. The required legal services are set out in the Invitation to Tender document, and include advice on structuring of partnering arrangements, developing a suite of contract and procurement documents, and legal advisory support for the procurement of a private sector delivery partner for the CCWP.

The key elements of this workstream are: 1. structuring advice on strategic partnering / joint venture arrangements; 2. contract development - anticipated to be a form of strategic partnering; agreement, with project delivery based on the Mutual Investment Model form of partnership with the private sector; 3. development of procurement documents and pre-procurement market engagement; 4. support to private sector classification analysis; 5. procurement of a CCWP private sector delivery partner; 6. signature of strategic partnering agreement and establishment of joint venture; and 7. transition to project delivery. This procurement is for legal advisory services to support these key activities, as further described in the Invitation to Tender document. Duties of care will be owed by the supplier to the other named contracting authorities as well as to Scottish Futures Trust.. Renewal: Extension will be permitted to accommodate programme changes and noting that a period of transition support post PSDP appointment will be required.
