## Summary

NHS Golden Jubilee procured replacement of the building-management system’s field controllers at Golden Jubilee National Hospital in Clydebank. The work covers 110 DR controllers and 135 TC controllers on the hospital’s existing system, which uses a legacy N2 communications network. The requirement is a controller replacement programme, including work on the installed system. The primary purpose is to replace the existing controllers while retaining the operation of the hospital’s building-management system. This is specialist building-controls work (CPV 50532000).

The procurement is complete and the contract was awarded to Johnson Controls, which also signed it. The recorded contract value is £75,168.74. The award date and contract period are not provided. NHS Golden Jubilee used a limited procedure without prior publication of a competition. It justified selecting Johnson Controls on technical grounds: the existing controllers use the supplier’s proprietary network, software and licences, and the buyer considered it the only provider able to migrate the live applications and operating parameters while maintaining system integrity and continuity. The procurement is presented as a single lot, and the work was required to be completed by 31 March; the year is not stated. The contract is governed by NHS Golden Jubilee’s standard service terms.

For suppliers assessing future demand from NHS Golden Jubilee, this award demonstrates a requirement for specialist building-management controls expertise, particularly in replacing legacy Johnson Controls DR and TC field controllers on the hospital’s N2 network. A credible competitor would need to show it can work with the installed controls environment and migrate existing applications, control strategies and operating parameters without disrupting system operation. The buyer’s stated rationale makes access to proprietary Johnson Controls software and licences central to the work, and it assessed an alternative approach as carrying technical and continuity risks. Suppliers should therefore be able to demonstrate relevant access, technical capability and experience with legacy controller migrations, alongside the capacity to replace a substantial set of controllers at an operational hospital.

## Notice

The requirement is specifically for a replacement programme of 110 DR controllers as well as 135 TC controllers.

### Lot Information

Lot 1

This is a Voluntary Ex Ante Transparency (VEAT) Notice. This is a Voluntary Ex Ante Transparency (VEAT) Notice. The National Waiting Times Centre Board (Golden Jubilee) intends to enter into a contract with Johnson Controls plc as the only supplier capable of meeting the Board's requirements. In accordance with our interpretation of the Public Contracts Regulations 2015, the required services can only be provided by a particular operator for technical reasons. The main site at the Golden Jubilee Hospital comprises of a JCI BMS which operate on Legacy N2 communication networks. The requirement is specifically for a replacement programme of 110 DR controllers as well as 135 TC controllers with works requiring to be completed by March 31st.. This will be governed under the GJ Standard Terms and Conditions for services.

### Procurement Information

Under Regulation 33(b)(ii) of the Public Contracts (Scotland) Regulations 2015, competition is absent for technical reasons. The National Waiting Times Centre Board (Golden Jubilee) is satisfied that Johnson Controls is the only provider capable of meeting the Board's requirements for the replacement of the existing controllers on site. The installed system comprises Johnson Controls DR field controllers operating on the proprietary N2 communications network. Recovery and migration of the existing controller applications, control strategies and operational parameters requires access to proprietary Johnson Controls software and licences that are not available to third parties. As the original system manufacturer, Johnson Controls is uniquely able to extract and migrate the live controller software whilst maintaining system integrity and operational continuity. Engagement of an alternative supplier would necessitate reverse engineering and re-creation of the existing applications, introducing disproportionate technical risk and the potential for loss of functionality. The Board is therefore satisfied that no reasonable alternative or substitute exists.
