Notice Description

Award of Residential and Nursing Care Homes. The Authority has to abide by Section 30 of the Care Act 2014 (and the Care and support and After-care (Choice of Accommodation) Regulations 2014) implements the important principle enshrined in the National Assistance Act 1948 (Choice of Accommodation) Directions 1992, of the right of the individual, subject to certain conditions, to be provided with their preferred residential accommodation. This provision applies to all care home accommodation, shared lives schemes and supported living accommodation, each of which are defined in the regulations and as a result means that individuals can choose the residential and nursing home of their choice. Contracting arrangements with all in-borough providers of residential and nursing home care is through a pre-purchase agreement under which arrangement there is no guarantee of placements (if any) made by the Authority and where the Authority pays a standard rate, pre-agreed with providers dependent upon placement type and number of placements actually made. Whilst Adult Social Care must seek to ensure Best Value in terms of the procurement of residential and nursing care, the structure of the existing market has set temporary contracts with it Residential and nursing home care providers to continue providing car until a new joint contractual agreement between the Authority and the North Tyneside Clinical Commissioning Group has been implemented. This will allow the procurment of the following residential, nursing and continuing healthcare placements resulting in a continuing Healthcare (CHC) rate.
