Notice Description

Appointment of a Quantity Surveyor to Audit the Newland Court Major Works 2017/18 Final Account. Currently in dispute between: The Leaseholders o Newland Court and the Council. Review the validity, veracity and justification of the final accounts for Newland Court and provide an independent and objective assessment. Project requirements: Non Exhaustive *Review all reports and emails of the Council employed QS, if any areas of concerns are identified to investigate further. *Assess to what extent the subsequent revised and revalued proposed works for each block validated by consultants were reasonable and required and ascertain why it was not issued to the lessees as a new section 20 or as a formal addendum. *Review the original scope of works on which the section 20 was based including the validation reports including photos and condition surveys for all the five blocks to ascertain how the decision was reached about the scope of the works. *Review statutory and non-statutory consultation with leaseholders from the feasibility stage of the process to completion of the works. *Review all the observations received and responded to by BHM (the Council). *Review the variation of works and why these were required, how the decision was reached, who signed off the variation and if leaseholders were informed of the significant variations by way of consultations, meetings etc. *Review all the appropriate documents from the feasibility stage of the process to completion of the works. *Review the evidence to quantify/validate the works and costs including copies of specialist sub contractor invoices where works fall outside the contract NHF rates; and / or obtain a detailed breakdown of non-NHF rates and prices. *Review standard/quality of the works, measurements, contractors progress reports and survey reports. *Review and confirm that the statutory section 20 process was adhered to. *Confirm that all legal requirements with regard to the process of the issue of the section 20, additional works, all advisements (or lack of) to the leaseholders, final accounts and all or any other related matters, fully comply with the legislation as set out in the 'Landlord and tenant act 1985'. *Review Pellings' contract to ensure it was compliant with the LTA and verify that their charges comply with the LTA 1985. No Prior relationship with Brent Council, Wates or Pellings since Jan 2005: *It is a requirement that your organisation have no conflicts of interest.
