Notice Description

This is a VEAT notice of Birmingham City Council's intention to enter into a Contract Variation for the ANPR network and back office system with the incumbent supplier following a period of 10 days from the date of publication of this notice. The Contract Variation provides for additional functionality within the back-office system to allow integration with the Central Clean Air Zone Service provided by Government.

The Clean Air Zone (CAZ) programme requires an Automatic Number Plate Recognition (ANPR) network and back office system to enforce the zone's vehicle emissions standards. The system will interface with a national CAZ framework known as the Central Clean Air Zone Service (the Central Service) which is produced by the Joint Air Quality Unit (JAQU), a government department. There is a requirement to modify the Council's contract with Siemens Mobility Limited to include further works which have been identified for completion in order to provide full integration with the Central Service. The Council and its contractors have been developing the CAZ camera network and back office solution since early 2019, during which time changes in the scope of the IT solution required to be delivered have been identified. Without delivery of the additional scope effective enforcement of the zone would be compromised. The change in scope is caused by a change to the overall end to end system for enforcement of all CAZs in the UK. The Council had a long-standing contractual arrangement with Capita Birmingham Ltd through which it sourced its IT solutions, including those for the CAZ. This agreement was partially terminated in 2019 and as a result a number of the contracts procured by Capita were novated across to the Council. This included the contract with Siemens for a CAZ ANPR network and back IT office system. This change builds on, and utilises, the bespoke infrastructure and security model/user management functionality that has already been commissioned and is currently under development by Siemens. In addition, the vehicle passage data and matching of a vehicle registration to a payment reference is held within the Siemens AWS-hosted solution, meaning that if any other party were asked to deliver this functionality it would have to integrate with the Siemens solution in some way. Involving another party at this stage would add significant risk to the CAZ programme including integration and interoperability risks. It would also incur significant inconvenience and delay to the schedule and would likely result in duplication of costs.

Procurement Information

Regulation 72(1)(b) PCR: For the reasons set out in II.2.4 above, the provision of additional services has become necessary: as a result of previous changes required to be made to the Council's CAZ solution. (i) cannot be made for economic and technical reasons due to the complexity of the transitional arrangements and the need to safeguard continued development which is vital to the delivery of the Birmingham Clean Air Zone; and (ii) would cause significant inconvenience and substantial duplication of costs for BCC in terms of the likely delays and increased risks of involving a third-party provider. BCC further considers the proposed extensions to be lawfully permitted in accordance with Regulation 72(1)(c) of PCR on the basis that: (i) the need for the additional development of Case Management functionality has fully crystallised following scope changes at a national level which BCC could not have foreseen; and (ii) the services to be provided by the incumbent will remain consistent and there will be no alteration to the overall nature of the Contract. BCC will publish a Modification Notice pursuant to Regulation 72(3) of PCR.
