Notice Description

The nature of this pandemic and the pace of interventions required has led the Council to quickly develop a hub and spoke model for delivery of rapid result testing in a targeted and scaled way to contain the spread of the virus and reduce transmission in higher risk population groups. The aim of this critical service is to capture data about levels of asymptomatic infection in target areas of Birmingham to reduce infection rates and particularly avoid further spread to vulnerable citizens that may develop a serious infection. This contract is to address high prevalence communities as identified by epidemiology and is delivered by mobile testing services.

Procurement Information

Birmingham City Council has activated its Business Continuity and Emergency Plans by applying regulation 32(2)(c) and regulation 72 (1) under the Public Contract Regulations 2015 in response to the Coronavirus outbreak in order to support the urgent issuing of lateral flow device testing kits to the service provider. This urgent award enables a contract to be executed to carry out the Council's Public Health duty and avoid further spread of COVID-19 in the local population. This is a retrospective notice due to the urgency of the requirement and necessity to secure services. Under PCR Regulation 32(2)(c) (Direct award due to reasons of extreme urgency) sets out: The negotiated procedure without prior publication may be used for public works contracts, public supply contracts and public service contracts in any of the following cases: (c) insofar as is strictly necessary where, for reasons of extreme urgency brought about by events unforeseeable by the contracting authority, the time limits for the open or restricted procedures or competitive procedures with negotiation cannot be complied with. The circumstances invoked to justify extreme urgency must not in any event be attributable to the contracting authority.
