Summary of the contracting process

The Warrenpoint Harbour Authority has successfully completed a procurement process for the purchase of three Combilift C16000 forklifts, classified under lifting and handling equipment for the goods category. The procurement method employed was a limited award procedure without prior publication, and the contract was awarded to Briggs Equipment UK Limited due to the absence of competition for technical reasons. The contract was officially signed on 29 April 2022, following a minimum standstill period specified by the Utilities Contracts Regulations. The procurement process was conducted in Newry, County Down, Northern Ireland.

This tender provides significant opportunities for businesses specialising in supplying lifting and handling equipment, particularly those focusing on niche products that meet specific technical requirements. Companies that manufacture or distribute multi-directional forklifts or other unique handling equipment that could cater to the needs of port-related activities may find this contract particularly relevant, especially given the specific health and safety stipulations outlined by the contracting authority.

Procurement Information

The Contract was awarded to Briggs Equipment UK Limited (Briggs) pursuant to Regulation 50(1)(c)(ii) of the Utilities Contracts Regulations 2016 (the Regulations). For the reasons set out below, Warrenpoint Harbour Authority (WHA) is of the view that the Contract could only be awarded to Briggs because competition was absent for technical reasons, and no reasonable alternative exists. Having undertaken research on the forkilifts available in the market, WHA is of the view that the Combilift C16000 is the only product in the market that is capable of fulfilling its technical and health and safety requirements, due to its multi-directional , side loading, 900mm load-base and load lifting capacity, which will enable consistent low level carriage of steel beams within spatially constrained aisles in WHA's steelyard. WHA understand that the C16000 is the only multi-directional forklift in the market with a 16 tonne capacity. WHA have been informed by Combilift that Briggs is the relevant sales agent from whom WHA can purchase the C16000s that meet its technical requirements. In light of the above, WHA is of the view that if it were to have put the contract opportunity out to tender in accordance with the Regulations genuine competition for it would have been absent, and in the circumstances there is no reasonable alternative to the Combilift C16000.
