Summary of the contracting process

The Lisburn and Castlereagh City Council has recently awarded a contract for the collection, recycling and/or recovery of wood from council household recycling centres. The contracting process was initiated through a tender and the contract was won by Skipway Waste Management and Recycling. The contract value is £631,786.00 GBP, signed on 21st September 2022, with a duration of 1440 days. The council allows for a further and final extension of 12 months due to unforeseen circumstances such as Brexit-related rising costs, post-Covid economic restart, and the global impact of the Russia/Ukraine war.

This procurement opportunity in the services category presents potential growth opportunities for businesses capable of providing wood collection, recycling, and recovery services. Companies with expertise in refuse disposal and treatment, particularly in managing mixed woods, virgin and non-virgin timbers, may find this tender suitable for their operations. The contracting authority, Lisburn and Castlereagh City Council, seeks suppliers who can meet the specified contractual waste standards and provide regular collection services within the UKN0E region.

Proposed cost increases to the existing contract are attributable to the on-going increasing costs associated with transport and processing (eg fuel, particularly the move from red to white diesel, energy and staffing) which have been fuelled by Brexit and economies restarting following Covid. The Russia/Ukraine war has also exacerbated fuel and energy costs at a global level. The contract allows for a further and final extension of 12 months from 31 July 2022 to 30 July 2023. The council are content that it is reasonable to assume that contractors would not have foreseen the current cost increases in delivering services under the contract at time of tendering. This direct award is permitted by Regulation 72(1)(c) of the Public Contracts Regulations 2015 (c) where all of the following conditions are fulfilled:-- (i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; (ii) the modification does not alter the overall nature of the contract; (iii) any increase in price does not exceed 50% of the value of the original contract or framework agreement.",
